E-Notarization for Philippine Notary Publics
The Supreme Court’s adoption of A.M. No. 24-10-14-SC opens a new chapter for Philippine notary publics. By becoming an Electronic Notary Public (ENP), you can perform notarial acts on electronic documents – both in-person and remotely – expanding your reach, improving your efficiency, and offering clients a modern notarization experience.
Why Become an ENP?
Expand Your Client Base
Traditional notarization is limited by geography – clients must physically visit your office. With Remote Electronic Notarization (REN), you can serve clients anywhere in the Philippines, and even OFWs at Philippine missions abroad.
Increase Efficiency
Paper-based notarization involves handling physical documents, maintaining a physical notarial book, and managing a physical office. Electronic notarization streamlines every step, letting you handle more acts per day.
Reduce Fraud Risk
Physical notarial seals can be forged. Electronic notarial seals are cryptographically secured and verifiable, protecting your professional reputation.
Future-Proof Your Practice
As Philippine courts, banks, and government agencies increasingly accept electronic documents, notaries who offer e-notarization will be better positioned than those limited to paper.
Requirements to Become an ENP
Under the Rules on Electronic Notarization, you must:
- Be a member of the Philippine Bar in good standing
- Not have been convicted of a crime involving moral turpitude
- Complete required training on electronic notarization procedures and technology
- Apply for a commission with the Electronic Notary Administrator (ENA)
- Use an accredited ENF to perform all electronic notarial acts
If you currently hold a traditional notarial commission, becoming an ENP is an additional commission – you can continue performing traditional notarization on paper documents while also offering e-notarization.
What Changes for Your Practice
Document Format
You’ll work with PDF and PDF/A documents instead of paper. Principals bring or upload electronic documents, and you apply your electronic notarial seal digitally.
Identity Verification
Instead of relying solely on visual inspection of a presented ID, you’ll use multi-factor authentication through the ENF platform:
- Government-issued photo ID
- Facial recognition
- One-time password (OTP)
This enhanced verification actually provides stronger identity assurance than the traditional “competent evidence of identity” standard.
Record-Keeping
Your physical notarial book is replaced (for electronic acts) by an electronic notarial book maintained through the ENF platform. Records are automatically uploaded to the SC’s centralized database, eliminating the need for physical submission to the Clerk of Court.
The Notarial Act Itself
The actual notarial act (acknowledgment, jurat, etc.) follows the same legal principles:
- For IEN: The principal appears in person, signs electronically, and you apply your seal
- For REN: The principal appears via videoconference, signs electronically, and you apply your seal remot- The audiovisual session is recorded
Revenue Opportunities
E-notarization creates new revenue streams:
| Opportunity | Description |
|---|---|
| Remote clients | Serve clients outside your physical area who previously couldn’t access your services |
| After-hours service | REN sessions can be scheduled flexibly, including evenings and weekends |
| OFW market | Serve the 10+ million OFWs who need notarization but are abroad |
| Corporate clients | Offer corporate governance document workflows (resolutions, certificates, SEC filings) |
| Law firm partnerships | Partner with firms that need notarization services for their clients |
Comparison: Traditional vs. Electronic Practice
| Aspect | Traditional Notary | ENP |
|---|---|---|
| Client reach | Local (must visit office) | National + OFWs abroad |
| Documents per day | Limited by physical logistics | Higher throughput |
| Fraud exposure | Physical seal forgery risk | Cryptographically secured |
| Record security | Physical book (can be damaged/lost) | Digital, backed up, SC database |
| Verification | Manual | Instant digital verification |
| Revenue potential | Geographically limited | Broader market access |
